The “Plant Finder Identifier & Care” app is designed to identify plants, diagnose plant diseases, provide daily tips, and interact via AI chat.
By downloading, browsing, accessing, or using this “Plant Finder Identifier & Care” App mobile application, you agree to be bound by these Terms and Conditions of Use. We reserve the right to amend these terms and conditions at any time. If you disagree with any of these Terms and Conditions of Use, you must immediately discontinue your access to the Plant Identifier App and your use of the services offered on the Plant Identifier app. Continued use of the Plant Identifier App will constitute acceptance of these Terms and Conditions of Use, as may be amended from time to time.
“App” refers to the “Plant Finder Identifier & Care” App, the software application developed and managed by Yehonatan Duan.
“Services” refers to all services provided through the app App, including but not limited to, plant identification, disease diagnosis, AI chat, articles, and daily tips.
“You”, “Your”, “User” refers to you, as a user of the app.
“We”, “Our”, “Us” refers to Yehonatan Duan, the individual developer of the app.
“API” refers to the Application Programming Interface, a set of rules that allows different software applications to communicate with each other.
1.1 You agree to use the App only for purposes that are permitted by (a) these Terms of Use and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions. You agree to comply with all local laws and regulations regarding the download, installation and/or use of the App.
1.2 By using the App, you are consenting to our processing of data as set forth in our Privacy Policy.
1.3 You agree that we are not responsible or liable for any content accessed from the App or third-party websites. You agree that you are solely responsible for (and that we have no responsibility to you or to any third party for) your use of the App.
1.4 You acknowledge that the App may communicate with our servers from time to time to check for updates to the App, such as bug fixes, patches, enhanced functions, missing plug-ins and new versions. By installing the App, you agree to such automatically requested and received updates.
1.5 You agree that we may stop (permanently or temporarily) providing the App (or any features within the App) to you or to users generally at our sole discretion, without prior notice to you. You agree that if we disable access to the App, you may be prevented from accessing the App or certain features within the App.
1.6 You may not distribute, publish, or send through an App: (1) any spam, including any unsolicited advertisements, solicitations, commercial messages, informational announcements, or promotional messages of any kind; (2) chain mail; (3) numerous copies of the same or substantially similar messages; (4) empty messages; (5) messages that contain no substantive content; (6) very large messages or files that disrupt a server, account, newsgroup, or chat service; or (7) any message that is categorized as ‘phishing’.
the app uses APIs for plant identification and diagnose diseases from a company named Plant.id and an AI chat that uses OpenAI’s ChatGPT’s API. Any photographs you provide for plant identification and the corresponding data received from the Plant.id API is subject to the privacy policy of Plant.id. The interactions with the AI chat and the use of the articles and tips are subject to OpenAI’s privacy policy and terms of service.
We reserve the right, in our sole discretion, to terminate your access to the App and the related services or any portion thereof at any time, without notice. Reasons for termination could include but are not limited to breaches or violations of these Terms & Conditions or the Privacy Policy, a request by you to terminate your account, discontinuance or material modification to the App, unexpected technical or security issues, and extended periods of inactivity.
Upon termination, all rights granted to you under these Terms will cease immediately, and you agree that you will immediately discontinue any use of the App. Termination of your access to the App will not relieve you of any obligations arising or accruing before termination or limit any liability that you otherwise may have to us, including without limitation, any indemnification obligations contained in these Terms.
All copyright, trademarks, design rights, patents, and other intellectual property rights (registered and unregistered) in and on the app and all content (including all applications) located on the site shall remain vested in us or our licensors.
In some cases, we may notify you of changes to the Terms & Conditions with a prominent notice on the Services (for example by way of a notification or pop-up), before the changes become effective and update the “last updated” at the top of this Terms & Conditions.
To the extent permitted by law, we exclude all liability for any loss or damage (including indirect, special, or consequential loss or damage) arising from the use of, or reliance on, any information on the App, whether or not caused by any negligent act or omission. The app nor the development team is not liable for damages or injury caused by actions based on inaccurate, misleading, incomplete or wrong information – whether it be a misidentification of species or a misattribution of attributes of a proposed class. For example, it could be poisoning by a fungus based on a misidentified species or its poisonousness, damage to a plant by a recommended phytosanitary intervention, injury caused by careless handling of an animal, etc.
